Terms & Conditions bdwebr.com provides web directory listing service. The goal is to list and promote all type of websites and promote them. We also offer website development services. This term is applicable to all our servcies both free and paid. This includes free listing and advertising service and development services and also to all of our paid services. bdwebr.com provides an internet domain name registration and hosting service. bdwebr.com reserves the right to suspend or cancel a customer's access to any or all services provided by bdwebr.com when bdwebr.com decides that the account has been inappropriately used or otherwise. Domain Name Registration We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should therefore not assume registration of your requested domain name(s) until you have been notified that it has or they have been registered. Any action taken by you before such notification is at your risk. The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority; you shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name. More information can be found here at icann We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute. We shall not release any domain to another provider unless full payment for that domain has been received by us. Shared & Reseller Hosting & Website Development bdwebr.com reserves the right to refuse service and /or access to its servers to anyone. bdwebr.com do not allow any of the following content to be stored on its servers: Illegal Material - any material which constitutes, or encourages the commission of, a criminal offence or which infringes any patent, trade mark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction. Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of bdwebr.com. Also includes any sites which provide "links to" information about such material or advertising for such material. Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material. bdwebr.com prohibits using the shared hosting account (any unlimited) as a file storage for commercial distribution requiring unacceptable usage of bandwidth,diskspace or cpu, this is defined by our HIGH RESOURCE USAGE POLICY (You can do this on any quota based account like reseller, vps or dedicated, or a quota based shared environment). This includes MP3, software or any other type of files. You may store moderate amount of files if you are not draining too much resources. Sending unsolicited emails using our server is strictly prohibited. This is considered illegal and will cause your account [Mail/Web] to be suspended or permanently disabled. Running IRC or chat scripts on the server is also prohibited. UNLIMITED USE POLICY Applicable to plans using unlimited resources. High bandwidth usage: bdwebr.com offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, bdwebr.com may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, bdwebr.com reserves the right to impose the High Resource User Policy for the consideration of all customers. REFUND POLICY Customer can ask for full refund within first month of service or partial refund anytime upto one year from the date of payment. PRIVACY AND DATA SECURITY POLICY We wont disclose the customers contact information, including name, email and contact address that we collect to any third parties. They will be kept private and only used for contacting the client for billing and support purposes. However if any situation arises, when law enforcement agencies are requesting data, we may disclose that information as per our legal liability. HIGH RESOURCE USER POLICY Resources are defined as bandwidth and/or processor utilization. bdwebr.com may implement the following policy to its sole discretion: When a website found to be monopolizing the resources available, the account holder will be contacted in order to discuss the situation. If no arrangement can be reached, bdwebr.com reserves the right to suspend or terminate the account. CANCELLATION bdwebr.com reserves the right to cancel service at any time. BACKUP bdwebr.com will backup your website, email, database and all other related data only if its mentioned in a particular package but does not gurantee 100% security in case of a disaster. We will certainly do what we promise to do but you are also suggested to keep a backup copy of you site data from time to time. INDEMNIFICATION Registered user agrees that it shall defend, indemnify, save and hold bdwebr.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against bdwebr.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless bdwebr.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with bdwebr.com's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from bdwebr.com's server. DISCLAIMER bdwebr.com will not be responsible for any damages your business may suffer. bdwebr.com makes no warranties of any kind, expressed or implied for services we provide. bdwebr.com disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by bdwebr.com and its employees. bdwebr.com reserves the right to revise its policies at any time. |
